legislation in South Africa.
As part of our programme, we will consider NEMA, NEM:AQA, NEMWA and the NWA and how this
legislation regulates, inter alia, the following aspects of non-compliance, with reference to case studies:

• Unlawful commencement;
• Compliance notices and directives;
• Penalties and offences;
• Private prosecutions;
• How to appeal a decision by the competent authority;
• Judicial review; and
• Reporting and responding to emergencies and/or incidents.
